Automotive Sound - End Of Prohibition: Cars With 'Pancadão' Sound Can Go Back To The Streets

Members approved the repeal of the standard banning audible sound equipment outside the vehicle. Change still depends on the Plenary vote to take effect.

Do you know that sound of car that looks more like an electric trio and that usually appears next to your house well at the time of your rest? That is, the use of equipment that produces audible external sound in vehicles has been banned for a year. And no matter the volume or the frequency, it is enough to disturb the public quietness to hurt Resolution 624, of the National Traffic Council (Contran). Only that determination can be with the days counted. A draft Legislative Decree authored by Rep. Cabo Sabino (PR-CE) was approved by the Committee on Transport and Transport of the Chamber of Deputies to repeal the current resolution. For the parliamentarian, the measure taken by the Contran "was opportunist, with the purpose of increasing the collection of public organs". According to Sabino, the law eliminated the requirement to measure automotive sound with a decibel meter. Deputy Marcio Alvino (PR-SP), rapporteur of the project, noted the fact that the definition of quietness was not violated, to the mere perception of the traffic control agent. "Would not we be subject to the discretion of this public agent?" He asked.

Cape Sabino intends to recover the validity of article 228 of the Brazilian Traffic Code, 2006. The previous standard established an acceptable limit of up to 80 decibels at a distance of 7 meters and of 98 decibels at only 1 meter. It should be noted that the current resolution makes exceptions to noise produced by horns, alarms, reverse signals, sirens by the engine and other mandatory components of the vehicle itself. Also excluded from the prohibition are vehicles providing service with sound emission of advertising, dissemination, entertainment and communication, provided that they are authorized by a competent body or entity.

The same release is applied to competition vehicles and public entertainment vehicles, provided that they are in appropriate places or presentation locations established by the competent authorities. For now, anyone caught hearing loud sound inside the car that can be heard also from the outside can be assessed with a fine of $ 127.60 and the inclusion of 5 points in the driver's license. The bill repealing Contran's determination will still be reviewed by the Commission on Constitution and Justice and Citizenship. If approved, it will go to Plenary vote // By Gazeta Do Povo.
